SEEDS IN A CUP® SHIPPING POLICY

Thank you for choosing Seeds In A Cup®. This Shipping Policy governs the shipment and delivery of all products purchased from seedsinacup.com (the “Site”). By placing an order, you agree to this Shipping Policy and our Terms of Service.


1. SHIPPING SCOPE


Seeds In A Cup® sells and ships only to addresses located within the United States and the District of Columbia. We do not accept international orders and do not ship internationally.


We reserve the right, in our sole discretion, to refuse, cancel, hold, delay, or limit any order or shipment at any time for legal, regulatory, compliance, fraud-prevention, operational, inventory, carrier, weather, safety, or other business reasons.


We do not ship to:
- international addresses;
- freight forwarders, reshippers, or export forwarding services;
- APO, FPO, or DPO addresses; or
- any destination we determine may create legal, regulatory, agricultural, customs, quarantine, carrier, or operational risk.


2. PROCESSING AND SHIPMENT TIME


All order processing, handling, packing, and shipment timeframes are estimates only and are not guaranteed.


We do not guarantee that any order will be processed, packed, shipped, or delivered within any specific period of time unless we expressly state otherwise in writing for a specific order. Orders may require additional time for inventory confirmation, payment verification, fraud screening, address validation, compliance review, product availability checks, weather-related precautions, carrier limitations, restricted-item review, seed or plant handling considerations, or other operational or legal reasons.


We reserve the right to take such time as we reasonably determine is necessary or appropriate to process, prepare, hold, release, or ship any order, to the maximum extent permitted by law. Delays in processing or shipment do not constitute a breach, do not create any right to cancellation, refund, damages, or other compensation, and do not waive any of our rights, except to the extent expressly required by applicable law.


3. SHIPPING METHODS


We may ship orders using USPS, UPS, FedEx, or any other carrier or fulfillment method selected by us in our sole discretion. Carrier selection may depend on destination, package size, contents, service availability, weather, routing, agricultural handling considerations, compliance factors, and other logistical concerns.


We may, in our sole discretion:
- split shipments into multiple packages;
- ship items separately;
- substitute carriers or service levels;
- consolidate or delay items;
- hold all or part of an order; or
- cancel all or part of an order before shipment.


4. SHIPPING CHARGES


Shipping charges, service fees, surcharges, and any promotional shipping offers are determined at checkout or otherwise communicated by us and may be changed, withdrawn, or limited at any time before order submission.


Any free shipping offer, if available, is promotional, temporary, and subject to change, suspension, limitation, or discontinuation without notice.


5. DELIVERY ESTIMATES; NO GUARANTEE


Any transit time, delivery date, arrival window, or shipping estimate displayed on the Site, at checkout, in a confirmation email, or otherwise communicated by us is an estimate only, not a guarantee.


Actual shipment and delivery may be delayed by events or circumstances including, without limitation:
- weather;
- natural disasters;
- carrier delays or service failures;
- routing disruptions;
- inventory shortages;
- fraud or security screening;
- payment verification issues;
- legal or regulatory review;
- agricultural, plant, pest, or seed-related restrictions;
- quarantine or inspection issues;
- labor shortages or disruptions;
- system outages; or
- any other cause beyond or within our reasonable control.


We are not liable for any delay in shipment, transit, delivery, attempted delivery, misdelivery, nondelivery, or carrier-related issue, to the fullest extent permitted by law.


6. TITLE AND RISK OF LOSS


Title to Products passes to you when we transfer the Products to the shipping carrier, unless otherwise required by applicable law. Risk of loss, theft, damage, delay, or nondelivery transfers to you upon our tender of the shipment to the carrier.


Any claim arising from carrier delay, mishandling, loss, theft, damage, or delivery failure is primarily between you and the carrier, although we may, in our sole discretion, choose to assist with a claim or replacement request.


7. ADDRESS ACCURACY


You are solely responsible for providing a complete, accurate, deliverable shipping address and all other required order information.


Seeds In A Cup® is not responsible for delays, losses, failed deliveries, returns, or additional costs caused by incorrect, incomplete, outdated, undeliverable, or rejected address information provided by the customer.


If a package is returned to us due to address error, delivery refusal, failed delivery attempts, or carrier nondelivery, we may, in our sole discretion:
- cancel the order;
- issue store credit less shipping, handling, return, or restocking costs;
- require payment of additional shipping charges before reshipment; or
- decline reshipment entirely.


8. RESTRICTED JURISDICTIONS AND COMPLIANCE HOLDS


Certain Products may be unavailable or subject to delay, hold, refusal, or cancellation due to federal, state, local, carrier, plant-health, agricultural, quarantine, pest, invasive-species, seed, or other legal or regulatory considerations.


We reserve the right to place any order on hold, request additional information, refuse shipment, or cancel an order at any time if we believe the shipment may violate law, create regulatory exposure, or otherwise present compliance risk.


You are solely responsible for knowing and complying with all laws, regulations, and restrictions applicable to your order and delivery address.


9. LOST, DAMAGED, OR DELAYED PACKAGES


If your package is marked delivered but you did not receive it, or if your package is delayed, damaged, or lost in transit, you should first contact the shipping carrier using your tracking information.


If the issue remains unresolved, you may contact us at contact@seedsinacup.com. We may, in our sole discretion, assist with claim documentation, carrier inquiries, replacement review, or another accommodation, but we are not obligated to do so.


Any replacement, reshipment, refund, credit, or other resolution will be provided, if at all, solely in our discretion and subject to our Terms of Service, Return Policy, Seed Growth Promise, and applicable law.


10. NO LIABILITY FOR SHIPPING DELAYS OR NONDELIVERY


TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEEDS IN A CUP®, KEVIN BRUCE LLC, AND OUR AFFILIATES, OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SUPPLIERS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, COST, CLAIM, DELAY, MISDELIVERY, NONDELIVERY, CONSEQUENTIAL DAMAGE, LOST PROFITS, LOST OPPORTUNITY, OR OTHER LIABILITY ARISING FROM OR RELATED TO SHIPPING, PROCESSING, HANDLING, CARRIER ISSUES, DELIVERY ESTIMATES, OR DELAYED OR FAILED DELIVERY, EXCEPT TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.


11. POLICY CHANGES


We may update or modify this Shipping Policy at any time in our sole discretion. Any revised version will be effective when posted on the Site and will apply to orders placed after the updated policy is posted.
